EJM Farming Investments SL (hereinafter, "EJM" or the "Seller") provides you with an online purchasing service that will allow you to buy the items available in our online store.
Below, we invite you to review the general terms and conditions of sale (hereinafter, "GTC" or "General Terms and Conditions of Sale") that regulate the conditions governing the use of this Website and the purchase or acquisition of products through the website www.eteranima.com (the "Website"). In this regard, the use of this Website constitutes, insofar as it applies to you, your acceptance of these general terms and conditions of sale. However, if you have any questions about them, you can contact our Customer Service.
These general conditions have been prepared in accordance with the provisions of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce and Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws.

ARTICLE 2 - Purpose
The purpose of these GTC is, on one hand, to inform potential buyers of the conditions and modalities under which EJM proceeds to sell and deliver the requested products and, on the other hand, to define the rights and obligations of the parties within the framework of the sale of products by EJM to the customer (hereinafter, the "Buyer"). These GTC will apply, without restriction or reservation, to all sales of products that EJM offers through the Website.
Consequently, placing an order for products offered for sale on EJM's Website entails for the Buyer the full and complete acceptance of these GTC, whose prior knowledge before placing the order the Buyer acknowledges.
EJM reserves at all times the possibility of unilaterally modifying these GTC. However, the GTC applicable to the Order will be those that the Buyer had accepted at the time of placing the Order.
These GTC will be completed with the general terms of use of the Website and with the provisions of the Privacy Policy and the Cookie Policy.
ARTICLE 3 - Contract formalization and orders
3.1 Rates
The sale price, indicated in euros, of the products offered on EJM's Website will be the price in effect at the time of placing the order (hereinafter, "Order". Order is understood as what is described in section 3.4 of these GTC). The sale price of the products that appears on the Website may be modified by EJM at any time, with the price that will apply to the purchase being the one that appears on screen at the time of placing the Order. This price will be applicable within the framework of distance selling.
EJM will make its best efforts to check and verify periodically any error in the prices of the products offered on the Website. In case there is any error in the prices shown on the Website, EJM will act as follows: (a) if the correct price is lower than what is shown on the Website, EJM will charge its members the lower of the prices and proceed with shipping the product(s); (b) if the correct price is higher than what is shown on the Website, EJM will contact the Buyer so that they give the corresponding instructions, either to proceed with the order or cancel the order at no cost to them.
The price does not include shipping costs, which will be billed as a supplement to the price of the purchased products. Shipping costs will be indicated before the Buyer registers the Order. The different delivery and shipping modalities are established in section 5.1 of these GTC and will be reminded on the Website; shipping modalities may be modified by EJM at any time. Therefore, EJM recommends that buyers periodically consult the GTC that appear on the Website.
Prices will include Value Added Tax (VAT), Canary Islands General Indirect Tax (IGIC) or Tax on Production, Services and Importation (IPSI) that, where applicable, may correspond and be applicable on the date of the Order in accordance with current regulations. Any modification of the applicable rate will automatically impact the price of the products that EJM sells on the Website.
In the case of deliveries outside the European Economic Community (EEC), and if the Website does not stipulate otherwise, customs duty costs will be borne by the Customer, as these are taxes from the recipient's country, and these costs are not related to sales services.
3.2 Product characteristics
The Buyer may select one or more products from among the different categories offered by EJM on the Website.
Without prejudice to the Orders placed by the Buyer, EJM may at any time modify the assortment of products offered for sale on the Website, especially as a consequence of restrictions linked to its suppliers.
In accordance with applicable regulations, the Buyer will have the possibility, prior to the Order, to know on EJM's Website the fundamental characteristics of the products they wish to acquire.
The products will meet the requirements of Spanish legislation in force. EJM will not assume any responsibility in the event of non-compliance with the legislation of a country other than Spain where the product is to be delivered (e.g., in case of product prohibition, etc.). It is the Buyer's responsibility to verify with the local authorities of the country other than Spain for product delivery the applicable limits for the importation and use of the products and services they wish to acquire.

3.3 Availability
The products shown on the Website will be valid as long as they remain advertised on it and, in any case, until stock runs out. In the case of products that are not in our warehouses, the validity of the offers presented by EJM will be subject to product availability. At the time of placing the Order, this will offer the Buyer information that, in principle, exists about product availability. Since this information comes directly from our suppliers, errors or modifications may exceptionally occur, with the Buyer not having the real information until the time of purchase.
In any case, in the event of total or partial absence of product availability after placing the Order, the Buyer will be informed by email, as soon as possible, of the product's unavailability and the total or partial cancellation of their Order.
In case of total Order cancellation:
The Buyer will be reimbursed without delay and no later than within fourteen (14) days following payment of the amounts they have paid.
In case of partial Order cancellation:
The Buyer's Order will be validated and the full amount of the Order will be charged to their bank account.
The available products will be delivered to the Buyer.
The Buyer will be reimbursed for the price of the requested product that was not available as soon as possible and at most within fourteen (14) days following payment of the amounts they have paid.
As specified above, EJM reserves the right to substitute the unavailable Product(s) with one or more similar Product(s), of at least equivalent value. If they do not wish to keep the substituted Product(s), the Buyer will have the possibility to exercise their right of withdrawal.
3.4 Order
Placing an Order is equivalent to accepting these GTC, the stipulations provided in the Legal Notice, as well as declaring to have read and know the Privacy Policy and the Cookie Policy, without prejudice to the particular conditions that the Parties may agree upon.
The Buyer will have the possibility to check the details of their Order and correct possible errors.
From the moment the Buyer confirms their Order by clicking on the "Confirm and pay" icon (hereinafter, the "Order"), it will be considered that they have knowingly accepted the content and conditions of the Order in question and, specifically, these General Terms and Conditions of Sale, the fact that their Order implies for them a payment obligation, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and requested by the Buyer.
Just by placing an order, the user automatically joins EJM's points benefit program. They can accumulate points on their next orders and also redeem accumulated points.
Once this phase is validated and the order is prepared, the Buyer can no longer cancel their Order. The sale will be definitive (subject to the Buyer's exercise of their right of withdrawal under the conditions provided in article 6 of these General Terms and Conditions of Sale). The Order will be confirmed by EJM by sending an email to the Buyer (the "Order confirmation email").
A second email will be sent to the Buyer at the time of shipping their Order.
EJM recommends that the Buyer keep these two emails. The Buyer is informed that the two aforementioned emails will be sent to the email address they provided for identification during the registration process, prior to placing the Order.
Furthermore, EJM assumes no responsibility in case of error in entering the email address or non-receipt of the Order confirmation email. In these cases, the sale will be definitive, except in case of Order cancellation by EJM, especially in the event of products without availability. However, the Buyer may exercise their right of withdrawal under the conditions provided in article 6 of these General Terms and Conditions of Sale.
If requested by the Buyer, we will send an email with their tax invoice. Requests must always be within 15 calendar days after the order delivery date.
In accordance with applicable regulations, EJM reserves the right to refuse or cancel for legitimate cause any Order in which the number of products or the amount to be paid (for a single order or for several accumulated orders) or other elements clearly show the development by the Buyer of an economic activity related to the requested products or, in general, any abnormal Order according to the jurisprudence applicable to the case.
Finally, EJM reserves the right to suspend or cancel the execution and/or delivery of an Order, regardless of its nature and degree of execution, in case of non-payment or partial payment of amounts owed by the Buyer, in case of payment incidents or in case of fraud, consummated or attempted, related to the use of EJM's Website, including fraud committed in connection with previous Orders.
ARTICLE 4 - Payment
4.1 Payment methods
The payment methods through which you can buy on the Website are bank card, PayPal, Apple Pay, Klarna or others and cash on delivery (cash on delivery has an additional cost of €6.5 and orders with a maximum value of €500 are allowed). The bank cards accepted on the Éter Anima Website are the following: Visa and MasterCard. Payment with PayPal is not compatible with coupon application.
All bank cardholders are subject to validation and authorization checks by the card issuer. If the buyer's payment card issuer denies, or for any reason does not authorize payment in our favor, either before or after a payment, we will not be responsible for any delay or lack of delivery.
4.2 Payment modalities
All Orders must be paid in euros, including all mandatory taxes and duties. Banking costs will, where applicable, be borne by the Buyer (including in the case of reimbursement).
4.3 Security in payment operations
In order to guarantee the security of payments made with bank cards, the Buyer must communicate to EJM the visual cryptogram (CVV) that appears on the back of the bank card used by the Buyer.
Within the framework of the fight against Internet fraud, data relating to the Buyer's Order may be communicated to third parties authorized by law or designated by EJM, for the sole purpose of verifying the Buyer's identity, as well as the validity of the Order, the payment method used and the intended delivery.
Once this control is completed, EJM reserves the right to require a photocopy of the Buyer's identity document and/or any other data relating to the Buyer's identity. The Buyer has rights conferred by personal data protection regulations as provided in the ecommerce Privacy Policy.
EJM uses a secure payment tool called "ADYEN". Payment security rests on Buyer authentication and the confidentiality of all data. To guarantee this security, the tool uses proven cryptographic techniques and meets the requirements established in the various banking regulations applicable in Spain.
ARTICLE 5 - Delivery and receipt
5.1 General provisions
The products requested by the Buyer in accordance with the provisions of these GTC may be delivered or collected, at the Buyer's choice, in the following manner:
- At the address that the Buyer had indicated as the delivery address for the corresponding Order (hereinafter, "Delivery address"). EJM only makes deliveries in Spain including the Balearic Islands. Deliveries are also made to the Canary Islands with an additional cost of €12.99. No deliveries are made in Ceuta and Melilla. In that case, the Buyer or the recipient of the Order will receive the products through the transport company chosen by EJM, having to sign an electronic acknowledgment of receipt. The aforementioned electronic receipt acknowledgment will serve as proof of Order delivery by EJM.
If the Order Buyer is absent at the address provided at the time of delivery, the buyer or the recipient of the Order will receive a notice from the agency (email, SMS or postal notice), informing whether their Order will have another delivery attempt or will be available at a pickup point.
After 15 days from the second unsuccessful delivery attempt, the package will be returned to EJM and the money refunded to the Buyer, by any means of payment, according to EJM's choice, previously deducting the corresponding return costs.
No claim regarding delivery will be admitted when the package appears as delivered, for which purpose the carrier's computer system (identification) will be conclusive.
The Buyer can also choose to send their order to a pickup point of their convenience. This option is available as an alternative to home delivery. Fresh products are not susceptible to being delivered to pickup points, so any order containing at least one fresh product cannot use this delivery option. Pickup point shipping is available throughout the mainland and the Balearic Islands. Not compatible with cash on delivery payment method.
The option to choose the transport agency with home delivery is not available for the cash on delivery payment method or delivery to the Canary Islands and Balearic Islands.
For shipments outside the European Economic Union, the customer may have to pay import taxes, customs duties or brokerage costs (delivery costs) for their order. These charges are independent of shipping costs and will be billed directly by the carrier of their choice.
5.1.1 Order shipping cost
Orders over TWENTY (€50.00) euros in the EU and NINETY ($90.00) in the US will be free of charge. For orders under this amount, shipping costs will be determined at the time of the purchase summary.
5.2 Anomalies, damage or deteriorated packages
5.2.1 General provisions
It is recommended that the Buyer, or the recipient of the Order, check at the time of delivery the external state of the package and the products.
In case of anomaly related to the package (damaged package, open package, liquid remains, etc.) or related to the requested product(s) (missing product(s), damaged product(s)), the Buyer must imperatively follow the corresponding procedure, among those described below (in articles 5.3.2 and 5.3.3 of these General Terms and Conditions of Sale), according to the state of the Order. Non-compliance with the appropriate procedure will exclude the possibility of recourse against the carrier and against EJM. Specifically, the Buyer cannot demand any reimbursement. The Buyer, or the recipient of the Order, also cannot demand from EJM the replacement of the requested products.
Likewise, the Buyer or the recipient of the Order will have the possibility to call EJM's Customer Service to know the modalities for returning the damaged product(s). The Buyer will in this case be obliged to follow the procedure for returning damaged products that had been indicated by EJM's Customer Service. Otherwise, the Buyer cannot demand reimbursement or substitution of the affected products.
Return requests motivated by receiving a product with packaging or labeling different from what was published on the Website as a consequence of updates and rebrandings of products and their packaging by the manufacturer will not be considered product anomalies.
5.2.2 Mandatory compliance procedures in case of damaged package
In case of incident noted in the presence of the transport company:

Reject the delivery and clearly and detailed manifest the incident.

Indicate the reason for rejecting the delivery to EJM Customer Service.
In case of incidents noted without the presence of the transport company:

Incident notification and claim formulation must be made as soon as possible and, in any case, within 3 business days from product delivery.
5.2.3 Mandatory compliance procedures in case of missing or damaged product
The Buyer must communicate the absence or degradation of the product to EJM Customer Service through the means specified in the previous section. EJM Customer Service may request any data relating to the identity of the Buyer or recipient of the Order and proceed to any verifications necessary for the case.
5.3 Delivery times
Delivery times begin to count from sending the Order confirmation email.
In the event that delivery times are exceeded for any cause other than force majeure, the Buyer will have the possibility to cancel their Order.
Delivery times for EJM orders are merely indicative. However, for some Orders, air or land transport times may be prolonged due to delays in air or land transport, customs retentions (for countries outside the European Union) or other unforeseen complications outside EJM's control.
ARTICLE 6 - Withdrawal rights and periods
6.1. Legal withdrawal right and period
6.1.1. Period for exercising the legal withdrawal right
In accordance with applicable regulations, the Buyer has a period of FOURTEEN (14) days, from the date of receiving the Order, to exercise their legal right of withdrawal without being obliged to justify their decision.
6.1.2. Products excluded from the legal withdrawal right
In accordance with applicable regulations, the legal right of withdrawal cannot be exercised in the case of Orders relating to:
- The supply of items that had been unsealed after delivery and that cannot be returned for hygiene or health protection reasons.
Consequently, the Buyer is warned that they cannot assert their legal right of withdrawal regarding items unsealed by the Buyer whose commercialization by EJM would involve risks for hygiene or consumer health protection reasons (e.g.: care products, makeup, immediate consumption products, food, etc.).
6.1.3. Consequences of exercising the legal withdrawal right
When products are susceptible to the legal withdrawal right, the Buyer who exercises their withdrawal right under the conditions provided in this article, both in relation to the period and in the modalities of product return, may obtain reimbursement of the amount paid for the acquisition of the returned products. The return of the paid amount must be made without delay, and in any case, before FOURTEEN (14) calendar days from the date the order arrives at EJM's facilities.
6.1.4. Expenses
In accordance with applicable regulations, product return expenses will be borne by the Buyer, except in case of non-conformity of delivered products with the Order (in which case return expenses will be borne by EJM).
6.2. Contractual withdrawal right and periods
In order to guarantee the satisfaction of Order Buyers, EJM accepts the return, by mail, of products requested on EJM's Website beyond the legal period mentioned above in article 6.1.1, under the conditions established below (hereinafter, "contractual withdrawal right").
6.2.1. Period for exercising the contractual withdrawal right
The Buyer has fourteen (14) days from the date of receiving the Order to return the Products.
6.2.2. Modalities for exercising the contractual withdrawal right
The modalities for exercising the contractual withdrawal right are those described in article 6.3 of these General Terms and Conditions of Sale.
6.2.3. Products excluded from the contractual withdrawal right
The contractual withdrawal right cannot be exercised in the case of Orders provided for in section 6.1.3 of these GTC.
Consequently, the Buyer is warned that they cannot assert their contractual withdrawal right regarding items unsealed by the Buyer whose commercialization by EJM would involve risks for hygiene or consumer health protection reasons (e.g.: care or makeup products). Furthermore, the Buyer cannot assert their contractual withdrawal right regarding products that have been subject to personalization at the Buyer's request. These provisions will apply without prejudice to the warranties established in article 7 of these GTC which remain applicable in their entirety.
6.2.4. Consequences of exercising the contractual withdrawal right
When products are susceptible to the contractual withdrawal right, the Buyer who exercises their withdrawal right under the conditions provided in this article, both in terms of periods and modalities of product return, may obtain reimbursement by LUJOVI of the returned products, as well as Order shipping costs in case of returning the entire order.
6.2.5. Expenses
Product return expenses will be borne by the Buyer except in case of lack of conformity of delivered products with the Order or in case of deteriorated products.
6.3. Modalities for exercising the legal withdrawal right and contractual withdrawal right
6.3.1. General provisions applicable to all return modalities
Products must obligatorily be returned to EJM in an appropriate state for commercialization (products in perfect condition, accompanied by their original packaging, accessories, leaflet, etc.) within a maximum period of fourteen (14) days from the date of their receipt. Returns of products occurring after said period will not be accepted.
Products must be accompanied by the Order number; it is the Buyer's responsibility to pack the products so that they arrive correctly at EJM's facilities.
In the event that the Buyer had benefited on the Website from a purchase offer, by which they were entitled, under certain conditions, to one or more products offered as counterpart to their Order, and that as a consequence of their exercise of the withdrawal right they lost the right to said offer; the Buyer must return, together with the products affected by the withdrawal, the offer product(s) they had received as counterpart to their Order so that EJM can consider their withdrawal request.
The Buyer's liability may be demanded in case of product depreciation as a result of handling it other than the handling necessary to establish the nature, characteristics and, where applicable, proper functioning of the products.
ARTICLE 7 - Warranties
7.1. Legal warranties
All products for sale on the Website are covered by the legal warranty of conformity with applicable regulations and by the warranty against hidden defects, which allows the Buyer to return defective or non-conforming products that had been delivered to them without costs.
7.1.1 Legal warranty of conformity
In accordance with applicable regulations, EJM is obliged to deliver products that are conforming with the contract, being responsible for any lack of conformity that exists at the time of product delivery. It will also be responsible for conformity defects resulting from packaging, assembly or installation instructions, when it is their responsibility under the contract or had been carried out under their responsibility.
To be conforming with the contract, the product must:

Be suitable for the uses to which products of the same type are ordinarily intended;

Conform to the description made by the seller and possess the qualities of the product that the seller has presented through the Website;

Present the quality that the Buyer can reasonably expect, taking into account public declarations made by EJM, particularly in advertising or labeling. Likewise, EJM will not be bound by these declarations if it demonstrates that it was unaware and could not reasonably be expected to know the declaration in question, that said declaration had been corrected at the time of contract conclusion or that said declaration could not have influenced the decision to buy the product.

Present the characteristics defined by mutual agreement between the parties or be suitable for any specific use intended by the buyer, brought to the seller's knowledge and that the latter had accepted.
The action resulting from conformity defects prescribes after THREE (3) years from delivery of the good.
7.1.2 Legal warranty for hidden defects
In accordance with applicable regulations, EJM will be obliged to provide warranty for hidden defects that the sold product may have, if they make it unsuitable for the use for which it is intended, or if they diminish such use to such an extent that, had the Buyer known them, they would not have acquired it or would have paid less for it.
The action resulting from hidden defects must be exercised by the buyer within SIX (6) months after discovering the hidden defect.
In the context of the legal warranty for hidden defects, EJM commits, after evaluating the hidden defect, at the Buyer's choice:

To reimburse the total price of the returned product or;
-
To reimburse part of the product price when the Buyer chooses to keep the product.
7.1.3 Warranty exclusion
Products modified, repaired, integrated or added by the Buyer are excluded from warranty. The warranty does not apply to products that have suffered deterioration during transport or as a consequence of misuse.
7.2 Modalities for executing legal warranties
When dealing with the legal warranty of conformity, the Buyer:

Has a period of THREE YEARS, from delivery of the good, to exercise the action;

Is dispensed from presenting proof of the existence of the good's conformity defect during the six months following delivery of the good.

Must keep the purchase invoice and/or Order delivery receipt.
The legal warranty of conformity applies regardless of any other commercial warranty granted.
For any claim relating to legal warranties, the Buyer must contact Customer Service through the means specified in these GTC.
These provisions do not exclude the withdrawal right provided in the previous article 6.
The warranty does not apply to products that have suffered damage during transport or as a consequence of inappropriate use.
7.3 Consequences of warranty execution
Within the framework of the legal warranty of conformity, EJM commits, at the Buyer's choice:

To replace the product with another identical one based on available stock, or
-
To reimburse the product price when product substitution proves impossible.
In the context of the legal warranty for hidden defects, EJM commits after evaluating the hidden defect, at the Buyer's choice:

To reimburse the total price of the returned product, or
-
To reimburse part of the product price when the Buyer chooses to keep the product.
ARTICLE 8 - Signature and proof
EJM works for the protection of its customers' personal data guaranteeing a high level of security; however, the Buyer must also participate in protecting their personal data. Specifically, the Buyer must maintain the security of their online transactions, for example, not communicating to anyone their identifier (Buyer's email address) and/or their password, and periodically changing the password. In this regard, EJM assumes no responsibility for the disclosure of data relating to the Buyer to any person who makes use of the identifier (Buyer's email address) and/or their password.
In this respect, the use of the identifier (Buyer's email address) and/or the Buyer's password will be proof of their identity and the enforceability, at the time of Order validation, of the corresponding amounts.
EJM assumes, in no case, any responsibility for fraudulent use of this data. The communication of the bank card number and the definitive validation of the Order will serve as proof of acceptance of said Order and the enforceability of the amounts committed for reserving the products that appear in the Order. Computer records, kept in EJM's and its associates' computer systems, will be considered proof of communications, Orders and payments made between the Parties.

ARTICLE 10 - Liability
10.1 Capacity
Prior to placing their Order, the Buyer declares having full legal capacity to be bound by these General Terms and Conditions of Sale. Consequently, in the event that a person who did not have legal capacity made an Order for items on EJM's Website, the legal guardians of said person (especially, parents or guardians) will assume full responsibility for said Order and, specifically, must satisfy its price.
10.2 Liability limitation
EJM's liability for the obligations established in these General Terms and Conditions of Sale cannot be demanded when the breach of said obligations is attributable to third-party acts, even when said acts were foreseeable, to the Buyer's fault or to the occurrence of a force majeure circumstance, as defined in the applicable jurisdiction, or any other circumstances that reasonably escaped EJM's exclusive control. The information available on the Website is provided without any warranty, neither implicit nor express, regarding its completeness, accuracy, currency, absence of infringement, availability, reliability or exhaustiveness of the data, products, accessories or services that appear on EJM's Website or about their suitability for the use that the Buyer plans to make of them. EJM DISCLAIMS ALL LIABILITY FOR DIRECT AND INDIRECT DAMAGES, FORESEEABLE OR NOT, SUFFERED IN CONNECTION WITH THE USE OF THE WEBSITE. IN THE EVENT THAT LUJOVI'S LIABILITY FOR DAMAGES SUPPORTED BY THE BUYER ATTRIBUTABLE EXCLUSIVELY TO ORDER PLACEMENT IS ESTABLISHED, SAID LIABILITY WILL BE LIMITED TO THE ORDER AMOUNT THAT THE BUYER HAD PAID TO EJM.
ARTICLE 11 - Personal data protection
To process the Order, EJM will collect the Buyer's personal data. 13.3 Applicable law and competent jurisdiction
For the resolution of any discrepancy that may arise in relation to these General Conditions and other Website policies, the parties submit to the jurisdiction and competence of the courts of Girona (Spain), with express waiver of any other forum that may correspond to them. 13.4 Validity
The GTC will apply during the entire period in which the products offered by EJM company remain online and until the expiration of warranty periods. In any case, the provisions of "article 10. Liability" will remain in force after the termination of the GTC.
